New Standard Contractual Terms

On the 31st January 2013 the commonly used terms of engagement for barristers taking instructions from solicitors, the Terms of Work and the Withdrawal of Credit Scheme, are abolished.

They have been replaced by the new Standard Contractual Terms.

The Contractual Terms are for use for instructions from solicitors and all persons/bodies authorised by the Solicitors Regulation Authority to carry out legal services.

The Terms enable barristers to sue for unpaid fees and are intended for use in privately funded matters, they do not apply to cases where the barrister is paid directly by the Legal Services Commission.

If you have any queries about the new Standard Contractual Terms please do not hesitate to contact the Senior Clerk, Scott Baldwin.
